a) To provide the students with the constitutive and instrumental elements for the settlement of international disputes; b) To study the various types of current international disputes and to understand the solutions thereto provided by the international community.
The Course describes all kinds of current peaceful dispute settlement mechanisms between States, at a diplomatic, political and legal level and analyzes the role of the international organizations, either through institutional mechanisms or through the action of their officials, as a forum (GATT) and as a provider of new kinds of peaceful dispute settlement mechanisms (their highest officials, especially the UN Secretary General).
1. Types of international disputes. The varieties of war prescriptions, “ jus ad bellum” and the disarmament; 2. Subjects involved in the international disputes: States, international organizations, individuals, legal entitities. Classification and types of international disputes; 3. Diplomatic and private international relations negotiation; 4. Mediation: the role of the high officers of the international organizations. A case study: the role of the UN Secretary General; 5. International conciliation regarding interstate relations, state-private parties relations and relations among private parties; 6. International arbitration in the interstate relations. Legal justification, jurisdiction and the power of the arbitrators, the procedure, Hague´s PCA; 7. Arbitral case law in the ad hoc arbitration and PCA; 8. Legal solutions, PCJ and ICJ. Jurisdiction, competence, procedure and legal nature of the decisions by international courts; 9. The international courts in the current times and the access to these courts by private persons and legal entities; 10. Disputes between States and foreign private parties – World Bank, international investments, competence and jurisdiction; 11. GATT. A case study. Dispute settlement in organizations for economic integration; 12. Cooperation between the Judiciaries of different States in civil and criminal matters. Jurisdiction of a States, limitations and extraterritoriality.
